Mile High Health Club Release of liability and terms and conditions agreement.
These Terms & Conditions (“Terms”) govern your access to and use of the Mile High Health Club website located at milehighhealthclub.life (the “Site”), and any related services, content, programs, communities, and applications, including our mobile application (collectively, the “Services”).
“Mile High Health Club” may also be referred to as “MHHC,” “we,” “us,” or “our.” By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) ELIGIBILITY
You must be at least 18 years old (or the age of majority where you live) to create an account or use portions of the Services that require registration. If you are under 18, you may use the Services only with a parent or legal guardian’s consent and supervision.
2) HEALTH & FITNESS DISCLAIMER (NO MEDICAL ADVICE)
The Services may include fitness, nutrition, wellness, training, lifestyle, and educational information. MHHC is not a medical provider. Nothing in the Services is intended as medical advice or as a substitute for professional care.
Consult a qualified healthcare professional before starting any exercise or nutrition routine, especially if you have any medical condition, symptoms, are pregnant or nursing, or are taking medication.
Assumption of Risk: You understand that physical activity involves inherent risk. You voluntarily assume all risk of injury, illness, or other harm that may result from your participation and use of the Services.
3) ACCOUNT REGISTRATION & SECURITY
To access certain features, you may need to create an account. You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Notify us immediately if you suspect unauthorized access.
4) SERVICES, CONTENT, AND CHANGES
MHHC provides educational and wellness-related resources, which may include a digital course, membership access levels, communities, and related tools.
We may update, modify, or discontinue any part of the Services at any time. We may also impose limits on certain features or restrict access to parts of the Services as needed for safety, security, compliance, or maintenance.
5) CHECKOUT, RECURRING BILLING, AND AUTHORIZATION
Some parts of the Services require checkout through a third-party payment processor.
By completing checkout, you authorize MHHC (and our payment processors) to charge your selected payment method for the amounts presented during checkout, including any applicable taxes.
A) One-time checkout (Course)
The Course is accessed after a one-time checkout transaction.
B) Recurring plans (Memberships)
Memberships may be available on a monthly or annual recurring basis. If you enroll in a recurring plan, you authorize recurring charges at the interval disclosed during checkout until you cancel.
6) CANCELLATIONS AND REFUNDS
A) Recurring plan cancellation (Memberships)
You may cancel a recurring plan through your account settings or by contacting support at [email protected]. Cancellation stops future recurring charges. Access generally continues until the end of the current billing period unless otherwise required by law or stated during checkout.
B) Refund policy
Refund eligibility, if any, is described at checkout or within the product description provided at the time of purchase.
If no refund terms are stated for a product, then all checkout transactions are final to the extent permitted by law.
C) Payment disputes
If you have a billing concern, contact support before initiating a payment dispute so we can help resolve the issue.
7) INTELLECTUAL PROPERTY AND LICENSE
All materials on the Services—including videos, workouts, text, graphics, logos, and downloads (“Content”)—are owned by MHHC or licensed to us and protected by intellectual property laws.
Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Content for your personal use while you remain in good standing.
You may not:
Copy, reproduce, distribute, sell, sublicense, or publicly display Content
Share access credentials or allow others to access Content through your account
Use Content to develop competing products or services
Bypass or attempt to bypass access controls
Violations may result in immediate suspension or termination.
8) COMMUNITY STANDARDS (IF APPLICABLE)
If the Services include a community, group, chat, or similar feature, you agree to:
Act respectfully and lawfully
Avoid harassment, hate speech, threats, or discriminatory conduct
Avoid posting illegal, obscene, defamatory, or infringing content
Avoid sharing private information about others
Avoid spam or unauthorized solicitation
We may remove content or suspend/terminate accounts at our discretion for violations or safety reasons.
9) ACCEPTABLE USE
You agree not to:
Use the Services for unlawful purposes
Attempt unauthorized access to systems or accounts
Interfere with security features, rate limits, or service stability
Introduce malware or harmful code
Scrape, crawl, reverse engineer, or disrupt the Services
Impersonate any person or misrepresent affiliation
10) USER CONTENT
If you submit any reviews, comments, photos, progress updates, testimonials, or other materials (“User Content”), you grant MHHC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that User Content for operating and improving the Services and for promotional purposes, unless prohibited by law.
You represent that you have the rights needed to submit User Content and that it does not violate any law or third-party rights.
11) RESULTS DISCLAIMER
Individual results vary. Any examples, testimonials, or outcomes described are not promises or guarantees.
12) THIRD-PARTY SERVICES AND PLATFORMS
The Services may depend on third-party services (including hosting, analytics, communications providers, and white-labeled platform infrastructure). We are not responsible for third-party outages, interruptions, or acts/omissions outside our control.
Your use of third-party services may be subject to their own terms and policies.
13) PRIVACY

14) DISCLAIMER OF WARRANTIES
THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free.
15) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MHHC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU REMITTED TO MHHC IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
(Some jurisdictions do not allow certain limitations, so these limits may not apply to you in full.)
16) INDEMNIFICATION
You agree to defend, indemnify, and hold harmless MHHC and its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from:
Your use or misuse of the Services
Your violation of these Terms
Your violation of any law or third-party rights
17) SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services if we believe you have violated these Terms or if necessary to protect the Services, other users, or our operations. Upon termination, your license to access the Content ends.
Sections that should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
18) DISPUTE RESOLUTION
Before filing a formal claim, you agree to contact us at [email protected] and allow at least 30 days for informal resolution.
19) GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
If any claim is permitted to proceed in court, you agree to exclusive jurisdiction and venue in the state and federal courts located in Florida, in a court of competent jurisdiction.
20) CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Continued use of the Services after changes means you accept the updated Terms.
